User Agreement

This User Agreement (the “Agreement”) is a legally binding document between you (the “User”) and DynamicTracking LLC, governing your use of DynamicTracking software and associated services (the “Service”). By accessing or using the Service, you agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree, you may not use the Service.

1. Eligibility
   1. You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service.
   2. By registering, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement.
2. License and Usage
   1. Dynamic Tracking LLC grants you a non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, in accordance with this Agreement.
   2. The license prohibits:
      1. Reverse engineering, decompiling, or otherwise attempting to extract the source code.
      2. Using the Service for illegal, fraudulent, or unauthorized purposes.
   3. Usage is limited to the number of users or teams outlined in your subscription plan.
3. Subscription and Payment
   1. The Service is offered on a subscription basis, with pricing and billing cycles outlined during registration.
   2. Payments are non-refundable, except as required by law.
   3. DynamicTracking LLC reserves the right to modify subscription fees upon prior notice.
4. User Responsibilities
   1. You are responsible for maintaining the confidentiality of your login credentials.
   2. You agree to:
      1. Use the Service only in compliance with applicable laws and regulations.
      2. Not upload, post, or transmit any harmful or malicious content.
5. Data and Privacy
   1. DynamicTracking LLC processes your data in accordance with its Privacy Policy.
   2. You retain ownership of your data but grant DynamicTracking LLC a limited license to use it to provide and improve the Service.
6. Intellectual Property
   1. DynamicTracking LLC and its licensors retain all rights, title, and interest in the Service, including but not limited to software, design, and trademarks.
   2. Any feedback or suggestions provided by you may be used by DynamicTracking LLC without obligation or compensation.
7. Service Availability and Limitations
   1. DynamicTracking LLC strives to provide uninterrupted access but does not guarantee uptime or error-free operation.
   2. Maintenance, upgrades, or circumstances beyond DynamicTracking LLC’s control may result in temporary disruptions.
8. Termination
   1. Either party may terminate this Agreement at any time.
   2. Upon termination, your access to the Service will be revoked, and any associated data may be deleted after a reasonable retention period.
9. Disclaimer of Warranties
   1. The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or merchantability.
10. Limitation of Liability
    1. DynamicTracking LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
    2. The User is responsible and liable for compliance with all applicable laws and regulations; included, but not limited to State and Federal laws.
11. Governing Law and Dispute Resolution
    1. This Agreement is governed by the laws of Colorado.
    2. Disputes will be resolved through arbitration in Denver, Colorado, unless prohibited by law.
12. Amendments
    1. DynamicTracking LLC reserves the right to update this Agreement. Changes will be communicated through the Service or via email. Continued use of the Service constitutes acceptance of the revised terms.

By using DynamicTracking LLC, you acknowledge that you have read, understood, and agree to this User Agreement and that this agreement is effective immediately and concurrently with your usage of the Service.
